孩子被旋转门咬出了血 家长酒店都有责任

　　第二天，等孩子的伤势稍微稳定一点，肖先生找到酒店讨说法。肖先生认为，事发时旋转门附近没有保安，大 堂工作人员也未能及时制止，导致孩子在推门时被门撞伤，因此酒店未能实现对消费者安全的保障，对本次事故负 有不可推卸的责任。而酒店方认为，酒店在旋转门上贴了“旋转门转动时请勿推拉，小朋友进入旋转门需由成年人 监护，请勿在旋转门内停留”的警示标语，事故主要是由孩子父母监护不力所致，且事发后酒店及时陪护孩子去医 院治疗，不应该承担主要责任。双方就责任认定协商不下，肖先生于是向鄞州消保委直属分会寻求帮 助。
　　家长和酒店方都有责任
　　消保委工作人员接到投诉后，向酒店的大堂副理核实情况，并查看了事发时的录像，录像显示，孩子推着旋转 门玩，后被快速转动的旋转门撞倒造成头部受伤，事发时大堂及旋转门附近确实没有酒店的保安和相 关工作人员。
　　消保委工作人员指出：酒店的旋转门并没有出现异常，酒店也贴有警示标语，孩子独自跑进去推动旋转门玩被 撞伤，父母监护不力是肯定的；但同时法律上不能推定每个消费者都能安全地使用旋转门，旋转门 (http://www.yonganmen.com)作为服务场所，酒店应该安排保安从旁指导消费者使用，履行提示义务。 事发时，酒店的保安不在门附近，酒店也负有责任。经消保委调解，最后双方商定：酒店一次性补偿肖先生医药费 5000元。
